Terms & Conditions

Article 1

Purpose

These general terms and conditions of sale (T&Cs) govern the contractual relationship between Ben Driver, a sole-trader private hire vehicle (VTC) company based in Bordeaux (33), France, and any individual or legal entity (hereinafter “the Client”) making a transport booking.

Any booking constitutes unreserved acceptance of these T&Cs by the Client.

Article 2

Services offered

Ben Driver offers the following transport services:

  • Airport, train station and all-destination transfers throughout Gironde and beyond
  • Wine tours and oenotourism circuits through the Bordeaux vineyards
  • Wedding transport (bride, groom and guests)
  • Corporate travel and business transport
  • Prestige and event rides
  • 7-seat van hire with chauffeur
  • Hourly or daily chauffeur service

All services are carried out in premium vehicles (Tesla Model Y, Mercedes E-Class, Mercedes V-Class) driven by professional chauffeurs holding a VTC professional licence.

Article 3

Pricing

All prices are quoted in euros (EUR), inclusive of all taxes. Ben Driver is registered under the VAT exemption scheme (Article 293 B of the French Tax Code): VAT is not applicable.

Transfer fares are calculated on a per-kilometre flat-rate basis including:

  • Base charge: €4
  • Per-kilometre rate (sedan): €2/km (daytime)
  • Per-kilometre rate (van): €2.50/km (daytime)
  • Minimum (sedan): €30 / Minimum (van): €45
  • Night and weekend surcharge: +20% (10 pm–7 am, Saturdays, Sundays and public holidays)

The price is fixed and guaranteed upon booking confirmation. It cannot be changed during the journey, except where the route is modified at the Client’s request.

For quote-based services (wine tours, weddings, chauffeur service), the price is communicated to the Client before booking and becomes binding once accepted.

Article 4

Booking and confirmation

Bookings can be made via WhatsApp, phone, email, or through the contact form on ben-driver-bordeaux.com.

A booking is considered confirmed once Ben Driver has sent an acknowledgement including a journey summary, pick-up date and time, vehicle type and guaranteed price.

The Client undertakes to provide accurate information when booking: pick-up and destination addresses, number of passengers, and flight or train number where applicable.

Article 5

Cancellation and modification

The Client may cancel or modify a booking under the following conditions:

  • More than 24 hours before pick-up: free cancellation, full refund where applicable
  • Between 12 and 24 hours before pick-up: cancellation with a 50% charge on the total fare
  • Less than 12 hours before pick-up: no refund; the full fare is due
  • No-show: the full fare is due

Journey modifications (change of address or time) are accepted subject to availability and may result in a price adjustment.

In the event of a duly evidenced flight or train cancellation, Ben Driver offers free rescheduling or a fee-free cancellation.

Article 6

Payment

Payment is due at the end of the journey, unless otherwise agreed in advance for quote-based services. Accepted payment methods are:

  • Credit/debit card (Visa, Mastercard)
  • Cash
  • Bank transfer
  • Monthly invoicing (for businesses, subject to prior agreement)

An invoice is issued on request.

Article 7

Client obligations

The Client agrees to:

  • Be present at the agreed pick-up location and time
  • Treat the vehicle and its equipment with care. Any damage caused to the vehicle will be charged to the Client
  • Not smoke inside the vehicle
  • Not consume food that may soil the vehicle interior without the chauffeur's permission
  • Respect the maximum passenger capacity per vehicle (4 for sedans, 7 for the van)
  • Ensure that children under 10 have an appropriate child seat (to be provided by the Client or requested from Ben Driver at the time of booking)

A 15-minute waiting time is included for standard pick-ups. For airport and train station transfers, free waiting time is 30 minutes after landing or train arrival. Beyond that, a supplement of €1 per minute applies.

Article 8

Ben Driver responsibilities

Ben Driver undertakes to provide a safe, punctual and comfortable transport service. Our chauffeurs hold the VTC professional licence and are covered by professional third-party liability insurance covering passengers.

Ben Driver cannot be held liable for delays caused by circumstances beyond its control: exceptional traffic conditions, severe weather, demonstrations, roadworks, or accidents along the route.

Ben Driver’s liability for items and luggage transported is limited to direct damage resulting from a proven fault by the chauffeur. The Client is responsible for monitoring their personal belongings.

Article 9

Lost property

If an item is left in the vehicle, the Client must contact Ben Driver as soon as possible. We will make every effort to return the item within a reasonable timeframe. Any delivery costs are borne by the Client. Ben Driver cannot be held responsible for the loss or deterioration of forgotten items.

Article 10

Complaints

Any complaint relating to a transport service must be submitted to Ben Driver within 7 days of the service, by email at reservation@ben-driver-bordeaux.com or by phone at +33 6 11 56 27 04.

We are committed to handling every complaint seriously and to providing a response within 15 business days.

Article 11

Dispute mediation

If a dispute cannot be resolved amicably, the Client may refer to a consumer mediator in accordance with applicable regulations. The Client may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Article 12

Applicable law

These T&Cs are governed by French law. In the event of a persistent dispute, the competent courts of Bordeaux shall have sole jurisdiction.
